The small printPrivacy

Privacy policy.

What we collect, why, who sees it, and how photographs work at a place where people are relaxed and not fully dressed.

Equity Magnet Pty Ltd, trading as The Banya Place (ABN 30 585 622 076) is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles to the extent they apply to a small business like ours, and we follow them regardless. This policy explains our practices in plain English. The photo section matters most to our guests, so it has its own heading.

1. What we collect

  • Contact and booking details: your name, email, phone number, the dates, times and number of people, and anything you write in a request form or message (the occasion, dietary notes for tea, your preferred ice-bath temperature).
  • Health information you choose to share so that the steam master can look after you — a condition, a pregnancy, a medication, an injury. This is sensitive information; we collect it only with your consent, use it only for your safety on the day, and share it only with the steam master and, if it ever comes to that, emergency services.
  • Payment details: stay payments are taken by Hospitable and its payment processor; session payments by bank transfer or a card link. We never see or store full card numbers.
  • Signed waivers for banya sessions (name, date of birth, emergency contact, health declaration, signature), kept on paper or scanned.
  • Photographs and video — see section 5.
  • Website data: our site sets no tracking cookies and runs no advertising. Cloudflare, which hosts the site, keeps standard server logs (IP address, browser, pages requested) for security, and its Turnstile check inspects your browser — not you — to keep bots out of our forms. When you send us a form we also record your IP address, approximate country, browser and device type, the page you came from and how long you spent on the page, so that we can tell real enquiries from spam and follow up any problem with a submission. Fonts are loaded from Google Fonts, which receives your browser's request. The booking calendar for stays is provided by Hospitable and may set its own functional cookies.
  • Supporters of the Bright bathhouse: if you add your voice on The bigger dream page we keep your name, email, suburb or postcode, who you are (local, visitor…) and your comment in a private spreadsheet. Only a first name, suburb and your comment are ever shown publicly, and only if you ticked the box allowing it.

2. How we use it

To reply to you, confirm and run your booking, look after you safely during a session or stay, take payment, send you the practical messages a booking needs (directions, the door code, what to bring), keep the records a business must keep, and — only if you have said yes — tell you about session dates, openings and news. Every marketing email has an unsubscribe link, and we never sell or rent your details.

3. Who we share it with

Only the services that run the business: Google Workspace (our email, calendar and the spreadsheets our website forms write to), Hospitable and Airbnb for stays, their payment processors, Cloudflare for the website, and our accountant and insurer when they need it. Some of these providers store data in the United States or elsewhere overseas under their own privacy commitments. We disclose personal information to others only when the law requires it or when someone's safety depends on it.

4. How long we keep it and how we protect it

Booking and payment records are kept for seven years, as tax law requires. Signed waivers are kept for seven years after the session (longer for anyone who was under 18 at the time, until they turn 25). Mailing-list details are kept until you unsubscribe. Supporter details are kept until the Bright project opens or you ask us to remove them. Everything lives in password-protected, two-factor accounts; paper waivers live in a locked cabinet.

5. Photographs and video

Your photos. You are welcome to take photographs and video on the deck, around the pool, the firepit and the grounds, and in the yurts and the cabin — and in the steam room, if the people in it agree. We ask you not to photograph other guests without asking them — particularly in the pool, the spa or the ice bath. What you and the people in your group do with your own photos is up to you: we are not responsible for a photo that another guest takes of you or shares, so if someone in your group would rather not be photographed, please sort that out between yourselves.

Our photos. We sometimes photograph and film sessions and stays for our own purposes — our website, Instagram and other social media, printed material and the story of the Bright bathhouse. When a camera comes out we will say so, and we keep to backs, hands, steam and wide shots unless you are happy to be recognisable. By booking you agree that we may publish images in which you appear, unless you tell us you would rather not — before the session, on the day, by ticking the box on the waiver, or afterwards by emailing us. If you ask us to, we will not publish an image of you, and we will remove any image of you from our own website and social media channels within a reasonable time; we cannot recall copies others have already made. Children appear in our images only with their parent's clear agreement on the day.

Cameras on the property. There are security cameras around the property, including near the banya, to look after guests and the place. There are none inside the steam room, the change areas, the bathrooms, the yurts or the cabin. Footage is kept for up to 30 days unless it is needed for an incident, and it is not published.

6. Your rights

You can ask to see the personal information we hold about you, to correct it or to delete it, and you can withdraw consent to marketing or to photographs at any time. Email enquire@thebanyaplace.au with “Privacy” in the subject line; we usually answer within a few days and never later than 30 days, and we may ask you to confirm who you are. If you think we have mishandled your information, tell us first and we will try to fix it. You can also complain to the Office of the Australian Information Commissioner at oaic.gov.au or 1300 363 992.

7. Changes and contact

We update this policy as the business grows — the Bright bathhouse will bring a booking system, memberships and more cameras pointed at steam. The date at the top tells you when it last changed.

Questions about any of this: enquire@thebanyaplace.au, 03 4714 7111, or write to us through the Contact page.
