Everyone who books a banya session accepts these terms: ticking the box in a request form, paying for a session or attending one all count as acceptance. If you book for a group, you accept on behalf of everyone coming and you agree to share these terms with them. Stays at The Cabin and Bogong Nights have their own accommodation terms.

1. Who we are and what these terms cover
These terms are between you and Equity Magnet Pty Ltd, trading as The Banya Place (ABN 30 585 622 076) (“we”, “us”, “The Banya Place”). They cover everything we do around the steam: private banya sessions at the Log Banya in Mount Beauty, sessions at the Bright banya once it opens, group and event sessions, individual whisk treatments (parenie), the sauna whisk lesson, whisks and other items we sell, and camping after a session.
Our accommodation terms cover stays at The Cabin and Bogong Nights, and our privacy policy explains how we handle your details and photographs. The participation waiver is the document each adult signs on arrival; it repeats the health and risk parts of these terms in the form Victorian law asks for.
2. Requests, confirmation and payment
A request through our website, by email, phone or message is not a booking. We check the date, reply personally — usually within a day — and confirm in writing. Your date is booked once we have received payment in full; until then we may offer it to someone else, and we will tell you if that happens.
Prices are in Australian dollars and include GST. The estimate in the request form is a guide: the confirmed price is the one in your written confirmation. Treatments and the whisk lesson have off-peak (Monday–Thursday) and peak (Friday–Sunday and Victorian public holidays) prices; the private session itself costs the same every day. Extra guests and extra hours are charged at the rates on the Log Banya page.
A private session is for up to eight guests and a maximum of twelve. The session runs from the booked start time — if you arrive late, the time is still yours but it does not move. Extensions on the day are at our discretion and charged at the extra-hour rate.
3. Changing or cancelling a session
Life in the mountains is weather-dependent and so are travel plans, so tell us as early as you can. Measured from your booked start time:
| Notice | What happens |
|---|---|
| 7 days or more before | Move to another date free of charge, or a full refund. |
| Less than 7 days, more than 72 hours | 50% of the session price is retained; the rest is refunded. Treatments and the lesson are refunded in full. |
| 72 hours or less, no-show, or leaving early | 100% is retained. We will still try to find you another date, but we cannot promise one. |
Guest numbers and treatments. The session price covers up to eight guests, so fewer people on the day does not change the price. Extra guests, treatments and the lesson can be added or removed free of charge up to 72 hours before; after that they are charged, because the steam master's day — and the limited number of parenie we can give — has been planned around them.
If we cancel. We run on a wood-fired stove in the Alps, and we cancel only when we must: Extreme or Catastrophic fire danger, a Total Fire Ban that affects the session, a road closure, flood, power or stove failure, or illness that leaves us without a steam master. If that happens you choose between a new date and a full refund. We do not reimburse travel, accommodation or other costs, so please consider travel insurance for a long trip. Rain, cold, snow and fog are not reasons to cancel — the banya is at its best in bad weather.
Transfers. You may give your booking to someone else; just tell us who is coming. Refunds go back to the account or card the payment came from, usually within five business days.
4. Your health
Heat, steam and cold water are strong medicine and they are not for everyone. Please speak with your doctor before booking if you are pregnant or breastfeeding, have a heart condition, high or low blood pressure, epilepsy, diabetes, asthma or another breathing condition, a skin condition, a recent injury, surgery or illness, or you take medication that affects how your body handles heat or cold. Come another time if you have a fever, an infection or an open wound.
Tell the steam master about anything that matters before the first round — quietly, if you prefer. The steam master reads the room and sets the heat, but only you know how you feel: leave the heat whenever you need to, drink water between rounds, and never go into the ice bath or pool alone or when you feel faint. Eat lightly beforehand; alcohol and recreational drugs do not mix with heat and we will refuse entry to anyone affected by them.
Parenie is a hands-on treatment: the steam master works over your body with warmed oak whisks and may touch you to position a towel or move a limb. You may ask for less heat, a lighter touch, or to stop at any time, and the steam master may stop a treatment if they think you have had enough. Our steam masters are trained in the banya tradition and in first aid; they are not medical practitioners and cannot give medical advice.
5. Acknowledgement of risk and waiver
Banya is a recreational activity with inherent risks that care and skill cannot remove: overheating, dehydration, fainting, burns from hot surfaces or steam, slips on wet decks and steps, cold-water shock, aggravation of an existing condition, and the actions of other guests. By booking and attending you accept those risks, and you agree to manage your own exposure sensibly and to follow the steam master's instructions.
To the extent the law allows, you release The Banya Place, its owners, steam masters and helpers from liability for personal injury, illness or death arising from the inherent risks of taking part, including where our services were not provided with due care and skill — but never where the harm is caused by our gross negligence (reckless disregard for the consequences of an act or omission). This limitation is made under section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and is set out in the prescribed form in the participation waiver, which each adult signs on arrival. Nothing here removes rights the law does not let us exclude.
Each adult guest signs the waiver before their first session; a parent or guardian signs for anyone under 18. If a guest declines to sign, they can enjoy the deck, the pool and the spa but not the heat, and the price does not change.
6. Session rules
A banya runs on consideration — for the room, for the people in it and for the neighbours. These are the rules; the steam master has the final say on the day.
- Shower first. Rinse off before the first round, without oils or perfume, and always sit or lie on a towel — your skin should never touch bare wood.
- Swimwear is worn everywhere on the property: steam room, pool, spa, ice bath and deck. Bring two towels, thongs, a water bottle and a dressing gown in the cooler months; felt hats are provided.
- Photos are welcome — in the steam room too — and follow our photo rules: ask before you photograph anyone else, and never photograph a stranger in the pool or the ice bath.
- Quiet voices in the heat, and silence during parenie — the person on the bench is the only one who matters for those minutes.
- Cold water with care. Lower yourself into the ice bath — no jumping, no diving, no pushing. Children at the water only with a parent beside them.
- No glass anywhere near the pool, spa or tubs. No alcohol before or during the heat. No illegal drugs. No smoking or vaping except where we show you.
- No food in the steam room. Tea and water are provided; the gas BBQ on the deck is yours — bring your own food and take your rubbish with you.
- Respect the place. We are a home-based business on a quiet rural road: keep noise down after 10 pm, park where we show you, stay out of the house and private areas, and leave the property as you found it.
- Respect each other. Comments about anyone's body, unwanted touching and any sexual behaviour end the session for the person responsible, without refund. We do not tolerate disrespect towards guests, steam masters or helpers.
We may refuse entry, end a treatment or end a session for anyone who breaks these rules or whose participation looks unsafe to us, including anyone affected by alcohol or drugs. No refund is given in those cases.
7. Children and young people
Families are welcome at private sessions. Anyone under 18 attends only with a parent or guardian who is present for the whole session, responsible for them and signs the waiver on their behalf. The steam master sets the heat gently for children and decides whether, and for how long, a child enters the steam room.
Children under 16 may have the Gentle first steam — the contactless treatment where the whisk moves the air, not the skin — but not the full parenie or parenie with scrub. Nobody under 16 enters the ice bath, pool or spa without a parent at the water's edge.
8. Your belongings and our property
Keep valuables at home or in your car. We are not responsible for the loss of or damage to personal belongings, including phones left near water. You are responsible for damage you or your group cause to the banya, the pool, the spa, the tubs, the grounds or anything else beyond fair wear, and we may charge you the reasonable cost of repair or replacement.
Oak whisks you buy are natural products: store them dry and they keep for a year or more. Treatments, lessons and whisks bought for a session are not sold separately from it.
9. Group and event sessions
For clubs, teams, retreats, hens, bucks and celebrations, the person who books is our contact and is responsible for the group: the headcount, the behaviour of everyone attending, payment, and making sure each guest has read these terms and signs the waiver. The maximum is twelve guests; anyone above the confirmed number is charged at the extra-guest rate or, if there is no room, turned away.
If you run a paid retreat or commercial event that includes a session with us, you need your own public liability insurance and must tell us in advance. Commercial photography and filming on the property are by written agreement only.
10. Camping after your session
A night under the trees at Bright is included with a private banya session there; extra nights are by arrangement. Sites are unpowered, on grass. Arrive after your session and leave by 10 am, taking everything you brought — there are no bins on the campground.
Fires only in the firepit on your camping area, with firewood bought on site or brought with you, and never on a Total Fire Ban day or when we ask you not to light one. Keep the fire small, never leave it unattended and put it out properly before you sleep. Children are supervised at all times: the creek, the firepit and the roads are unfenced. Generators, fireworks and loud music are not permitted; quiet after 10 pm.
11. Gift vouchers
Gift vouchers are valid for three years from the date of purchase, can be used towards any session, treatment, lesson or whisk at the price current on the day, and are not redeemable for cash. A voucher bought at the off-peak price can be used on a peak date by paying the difference. Lost voucher codes can be re-issued to the original purchaser.
12. Our liability and your consumer rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under that law where it would be unlawful to do so.
Subject to that, and to the extent the law allows: our liability for a failure of a consumer guarantee is limited to supplying the service again or paying the cost of having it supplied again, at our choice; we are not liable for indirect or consequential loss, including travel and accommodation costs; and our total liability to you in connection with a booking is limited to the amount you paid for it. The release and waiver in clause 5 apply to personal injury, illness and death arising from the inherent risks of taking part.
You agree to compensate us for loss or damage we suffer because you or a member of your group broke these terms or acted recklessly, to the extent you or they caused it.
13. General
We may update these terms; the version published on this page applies to bookings made after the date it is posted and does not change a booking you have already made unless the law requires it. These terms are governed by the laws of Victoria, Australia, and you and we agree to the non-exclusive jurisdiction of its courts. If a clause turns out to be unenforceable, the rest still applies.
If something goes wrong, tell us first — most things are fixed with a conversation. You can also contact Consumer Affairs Victoria.
